Man With BAC 3X Legal Limit Crashes Into Barn In PA: Police

A man crashed into a barn while driving drunk with a blood alcohol level more than three times the legal limit, according to a release by police.

New Holland police were called to a vehicle crash in the 900 Block of Martindale Road of Earl Township in Lancaster County on Jan. 7 around 1:30 p.m., according to a release by the department.

Upon arrival police found a vehicle crashed into the side of a barn, according to the release.

Andrey Fleyta, 40, of Ephrata, was identified as the driver and sole occupant to the vehicle, according to police.

Fleyta was not injured, but was so intoxicated, "officers immediately noticed obvious signs of intoxication, but Fleyta refused to complete field sobriety tests," the release states.

A test later showed Fleyta's BAC was .274% and the legal limit is .08%, according to the release and state law.

He has been charged with the following, according to court documents:

  • M DUI: General Impairment/Including of Driving Safely - 1st Offense
  • M DUI: Highest Rate of Alcohol (BAC .16+) 1st Offense
  • S Careless Driving

The first offense charges are unusual seeing that this is his fourth time of driving into the influence and not his first time driving with  a high BAC either, based on court documents.

His preliminary hearing has yet to be scheduled.
